Important Workers Compensation Information on Furloughed Employees
Please be advised that the Division of Insurance has approved a new Workers Compensation class code #0012 with a rate of $0.00 for employers that paid furloughed employees due to COVID-19.
Furloughed Employees are employees who continue to receive payments during a temporary layoff or an involuntary leave and are not performing work for an employer due to COVID-19. This means the portion of salary they are paid as furloughed employees would not be included in generating your Workers Compensation Premium.
If an employee is requested to perform any duties for an employer, the employee is not deemed a paid furloughed employee and payroll will be assigned to the classification applicable to the work being performed. The new code is subject to the following and the employer must maintain separate, accurate and verifiable records that include:
- A list of all paid furloughed employees
- Their normal workers compensation classification
- Their weekly wage
- Their furloughed date
- Their anticipated return to work date
